Digital Delivery, Cancellation & Refund Policy

This policy outlines the fulfillment, delivery, and refund frameworks for all medico-legal audits and advisory services provided by Dr. Himanshu Vats via medicolegalexpert.in.

By remitting payment for any consultation level across any audience vertical (Patients, Litigators, or Hospitals), the Client explicitly agrees to the terms outlined below.

1. Digital Delivery & Fulfillment Policy

medicolegalexpert.in is a digital, knowledge-based technical consultancy. We do not ship physical goods, products, or hardcopy reports. All deliverables are fulfilled digitally.

  • Delivery Mechanism: All Written Advisories and Medico-Legal Assessment Reports are delivered as secure, digitally signed PDF documents to the Client's registered email address. Telephonic forensic reviews (Patient Level 1 — ₹5,000) are fulfilled via a secure, scheduled digital teleconference link.
  • Commencement of the SLA: The delivery timeline does not begin at the moment of payment. The fulfillment clock strictly begins only after the payment is realized AND the Client has successfully uploaded the complete, legible set of clinical documents to our secure intake vault.
  • Patient Level 1 (₹5,000) & Level 2 (₹15,000) and Litigator Level 1 (₹10,000): Fulfilled within 3 to 5 business days post-ingestion of the complete clinical file.
  • Litigator Level 2 (₹25,000) and Hospital Level 1 (₹50,000): Due to the exhaustive nature of comprehensive BHT and SOP audits, delivery of the final forensic report takes between 10 to 14 business days post-ingestion.
  • Hospital Level 2 (Custom Retainer, starting at ₹1,50,000): Delivery timeline is agreed upon at the time of retainer execution.
  • Delays: If a submitted clinical file is extraordinarily voluminous or medically illegible, Dr. Vats reserves the right to extend the delivery timeline. The Client will be notified in writing of any such technical delays.

2. Cancellation Policy

Due to the highly specialized, bespoke nature of forensic auditing:

  • Once a payment is successfully processed and the clinical documents are ingested into our system, the technical audit is deemed "Initiated."
  • No Cancellations: The Client cannot cancel the service, withdraw the files, or terminate the engagement mid-way. Once initiated, Dr. Vats' technical time and intellectual property are irrevocably deployed.

3. Strict Non-Refund Policy

All fees collected by medicolegalexpert.in are classified as non-refundable technical review fees. To ensure absolute clinical neutrality and scientific independence, we operate under a strict zero-refund doctrine. Refunds will NOT be granted under any of the following circumstances:

  • Unfavorable Findings: If our objective forensic audit reveals that the Client's legal claim lacks medical merit, or that a hospital's defense is clinically indefensible, no refund will be issued. You are paying for the truth of the scientific record, not a manufactured legal narrative.
  • Change of Mind: If the Client decides to abandon their litigation, settle out of court, or otherwise not utilise the Assessment Report after payment has been made.
  • Document Insufficiency: If the Client fails to provide complete hospital records, resulting in a limited or inconclusive Medico-Legal Assessment Report.

4. Exceptions (Technical Gateway Errors Only)

The ONLY exception to the zero-refund policy applies to technical payment gateway errors.

  • If a Client is double-charged (charged twice for the same transaction) due to a network timeout or Razorpay server error, the duplicate amount will be refunded.
  • The Client must email grievence@medicolegalexpert.in within 48 hours of the duplicate charge, providing the transaction ID.
  • Approved duplicate refunds will be credited back to the original source of payment within 7 to 10 working days.
